Terms of Service / Shipping Policy

We “Aggressive Garden” reserve the right to refuse any customer service for an reason. Refunds without just cause are subject to a 15% restocking fee.

General Delivery Policy:

By use of this site, customers authorize the carrier to leave a package at the destination delivery address without obtaining a signature if the carrier driver deems the location to be safe. Customers who are not able to locate the package that is claimed as delivered must follow the instructions for filing a claim listed below under the heading “Incorrect Delivery and Lost Package Claims.”

How does shipping work?

When ordering online, our website calculates the shipping charges automatically, giving you the options to ship via FedEx or UPS Ground/Home Delivery and FedEx or UPS 2 Day. When your order is large enough that it may be cheaper to ship by truck and we will provide you with a freight quote. Most orders are shipped within 24 – 72 hours.

As a rule of thumb, shipping charges we assess simply amount to whatever FedEx or USPS published rates are with 0% markup.

How do I calculate shipping?

Simply put, we are always looking for the cheapest method of shipping available for your order. Using our interactive shipping calculator found in your cart you’ll be able to look up the shipping cost for your order.

  • We ship via FedEx/UPS Home Delivery to residences and via FedEx/UPS Ground to businesses.
  • Shipping is assessed using the same method employed by FedEx/UPS, based on weight and zone.

Combinable Items: Individual items weighing less than 40 lb are generally “combinable”, i.e. they can be combined and shipped together in boxes weighing up to 70 lb (over 70 lb, FedEx/UPS Ground rates are significantly more expensive). Items weighing over 40 lb are heavy and may ship alone to avoid damage to other products. If your combinable items total 70 lb or less, they will fit in a single box. If your combinable items total more than 70 lb, they may have to ship in more than one box, so please figure the cost of each box separately.

Non-Combinable Items : Individual items that already come in their own packaging, or are too long or too big to be boxed up with other items. Figure the shipping cost for each non-combinable item individually, then add to the cost of your other boxes.

How fast is shipping?

We normally ship all orders via FedEx/UPS Ground or via Freight Truck, while expedited shipments ship via FedEx/UPS Air 2 Day. On average, we ship in-stock items within one to three(3) business days of receiving your order.

If some items on your order are temporarily out of stock, we will hold your order for up to 1 week.

If we expect a longer delay, we will contact you to give you the options of

(a) shipping what is currently available and the back-ordered item(s) later (shipping charges will likely be higher in such a case) or

(b) waiting until everything is in stock before shipping or

(c) canceling the back-ordered item(s).

We will always do our best to rush your order (same day shipping for orders received before noon Pacific time) if your crop is in dire need of one of our pest controls or any other critical product.

FedEx/UPS Ground delivers Monday-Friday from 8 a.m. to 5 p.m.

How does freight work?

If shipping via truck, be aware that you must be able to accommodate a truck at your residence/business and that it is your responsibility to unload it. Some items cannot be unloaded without using a forklift/lift gate. If unloading by hand, be prepared to off-load the pallet that holds your order in approximately 15 minutes or you may be charged an additional fee by the trucking company for the extra time (possibly up to $100/hr).

Do not sign for your order until you have confirmed an identical count of boxes, bags, rolls, bundles, pails, etc. and have checked very carefully for apparent and/or concealed damage. We will not accept any responsibility for missing and/or damaged items unless you note a count discrepancy and/or identify damage on the bill of lading at the time of delivery!

Tracking and Receiving Orders:

All orders shipping via FedEx or UPS, with the exception of drop-ship orders, will be provided with tracking information via an email to the email address provided on the order on the day the order is shipped. Please contact us immediately if you think your shipment is lost or if your shipment arrives damaged.

When your order arrives, open the package immediately and inspect the content against the packing slip; it is especially important to check viability on living products immediately. Notify us immediately of any shortages or damage, do not discard any damaged items or shipping cartons. The shipping company may require an inspection prior to approving any claim.

Claims Policy:

Visible Damage, Concealed Damage, and Missing Content Claims – Visible Damage is defined as any damage to the packaging that is identifiable without opening the package at the time of delivery. Concealed Damage is defined as any damage that is not immediately noticeable at the time the package is opened or when the product is first used. Missing Content is defined as any package that is missing product that the packing slip states is included. These types of claims must be made directly to Aggressive Garden within 5 business days of delivery. Any claims made after that time can not be honored. Incorrect Delivery and Lost Package Claims  Incorrect Delivery is defined as any incident where the driver delivers the package to the wrong address or individual. Lost Packages may occur in two ways. First, lost packages may occur when packages are not able to be located within the carrier’s network. Second, a package may be considered lost when the carrier claims delivery was completed by leaving the package on the doorstep, but the customer cannot locate the package. Both incorrect delivery and lost package incidents are usually discovered through standard tracking of the package.

Claims for either of these problems must be made directly to Aggressive Garden upon discovery. No claims will be honored after 30 days from shipment date. Please contact Aggressive Garden at 713-681-7764 or email Support@AggressiveGarden.com to make such a claim.

Incorrect Product Claims – Aggressive Garden must be notified directly within 30 days of shipment of any package received where contents incorrect. Please contact Aggressive Garden at 713-681-7764 or email Support@AggressiveGarden.com to make such a claim.

Shipping to Hawaii, Guam, Alaska, Puerto Rico and the US Virgin Islands:

Items are generally shipped to these locations via USPS Priority Mail. USPS does not guarantee transit time and Parcel Post can take up to several weeks to AK, HI, and PR. FedEx Service is available but is generally quite a bit more expensive. Boat and Barge shipments for palletized orders are available. Call for a quote. Perishable items and beneficial insects cannot ship to these locations.

Expedited Shipments:

FedEx / UPS2 Day services only run on business days. FedEx / UPS 2 Day orders placed on Friday will not arrive until Monday.

Drop Ship Orders:

Drop ship orders will often be delivered within one week of ordering, but in some cases these orders can take longer due to product availability and weather delays. Once an order has shipped, your order cannot be canceled. Drop Ship orders will be updated with a email containing the tracking number as soon as the product has shipped.
